Ft. Lauderdale, Fl. – Florida broker dealer Calton & Associates and one of its stock brokers are facing a claim for damages from the Broker’s own nephew, niece and their grandmother, alleging that his unsuitable high risk investment strategy included investing in the “Next Aspirin.”
The claim, filed on behalf of the broker’s three relatives by the law firm of Mark A. Tepper, P.A., alleges that Calton and its broker exploited their trust.
“Calton’s broker misled Claimants into giving him their hard earned savings by telling them how much money he was going to make for them while misrepresenting the safety of Respondents’ high risk investment strategy,” the claim alleges.
“Respondents put Claimants in harm’s way by making unsuitable recommendations. [He] was not just a broker; he was a member of the family. Therefore, they trusted him,” the claim argues.
The claim further contends that Calton & Associates is liable for punitive damages.
Mr. Tepper recently filed claims against Calton and Associates on behalf of a former police officer disabled in the line of duty, as well as a retired police captain.
Mr. Tepper previously represented a Fort Myers couple with their claim against Calton. The 2010 award for damages, obtained for the couple, stated, in part, “Respondent Calton’s failure to detect [the broker’s] wrongful conduct and failure to supervise the investments in Claimants’ accounts rose to the level of gross negligence pursuant to Florida Statute 768.72.”
